Bengaluru New Parking Laws

Bengaluru is all set to solve the parking problem and the problem of congestion in the city as Bruhat Bengaluru Mahanagara Palike has passed bylaws which make provision of parking on the ground floor mandatory for the apartments having more than two floors. BBMP was working on the proposal of stilt parking in the year 2014 with a committee being set up for the purpose. Various options and the pros and cons of the proposal were being weighed. With the new bylaw being passed many are optimistic about the decongestant of the city.
  
What do the residents say?

In an opinion survey of the residents our research team found out mixed reactions of the residents of Bengaluru. Mr. Pandit residing in Malleshwaram as a tenant opined “This area is one of the oldest of Bengaluru and many people here are exceptionally rich staying in an apartment or a house with multiple cars without a parking space for all the cars they possess. They either park it on the road or on the footpath creating problems for people to walk or vehicles to ply.”

It has been observed that buildings of many premium areas of Bengaluru have provisions for parking spaces in the ground floor and many areas are still having problems of parking spaces with the roads having the parked vehicles on the either side. Such areas are Jalahalli, Vijayanagar, Sanjaynagar and Malleswaram.

What is on the anvil?

The BBMP authorities opine that the proposal for mandatory ground parking is still being worked on but as per the bylaws passed the buildings with (G+3) structure that is with three floors above the ground has to be 11.5 meters in height. Government is still evaluating the proposal and may increase the stipulation of the building heights.

What does it mean to the developer?

The Real Estate Developers have to be ready to invest more as the heights of the buildings are being increased. With mandatory stilt parking the price of the building may increase in few areas as the builder has to make provisions for the parking space for the owners. 
Delhi already made stilt parking bylaws and made it mandatory but the enforcement was kept in abeyance owing to a dispute and a subsequent stay order from the court.
 
What does the court’s verdict say?

In a judgment on 2010 the SC ruled in the case of two builders Nahalchand Laloochand Pvt. Ltd. Vs. Panchali Co-operative Housing Society Ltd. [AIR 2010 SC 3607] the honourable supreme court ruled that no developer is entitled to sell any parking area or stilt parking space as independent units separately as it belongs to the owners of the apartment and constitute as ‘common areas and facilities’ of the occupants. The court further stated that only right the developer has is to charge the cost of the parking space or the stilt parking and to add it to the cost of carpet area of the flat from each buyer of flats. 

Thus with such laws in the country the developers are sure to add the carpet area of the parking space as additional super-built area and this could make the prices of the apartments surge higher.
